
Burglary is one of the most common criminal charges in Colorado, and, perhaps, the most common felony. (Though 3rd-degree Burglary is a misdemeanor.) Both 1st- and 2nd-degree Burglary revolve around breaking or unlawfully entering into a building or home with the intent to commit a crime, which can be theft, assault, sexual assault, or some other crime. The exception, 3rd-degree Burglary, is breaking into a container, such as a safe or cash register, with the intent to steal what is inside.
